How does the Credit Card Act of 2009 affect my current variable rate balance?
I have a variable rate on my credit card balance right now and based on what I am reading in articles, it sounds like credit card companies now have the right to hike up variable rates at their discretion but must give you an opt out option. The opt out option won't work for most people like myself because it is detrimental to your credit score. So... is this true? Or, are they not allowed to touch current balances on credit cards before the law took effect in Feb 2010?

Credit Card companies which offer variable rates are generally tied to the prime index, and fluctuations to your rate are based on that index. So if the prime rate was at 3.5% and your card issues offered a prime + 10% then your APR would be 13.5%. In this example 10% is the margin between the prime rate and your APR. If the prime rate or whatever index your rate is tied to goes up, then your rate also goes up. However, card holders generally will not be able to change the "margin" on existing balances under the new laws according to a Fed Spokesperson. For variable rate cardholders you cannot opt-out of rate increases, are not required to get 45 days noticed before rate increases, increases in the prime rate can be applied to existing debt.
For fixed rate credit cards the new laws protect customers against all of the items mentioned above. Choosing to opt-out of the interest rate high should not affect your credit score unless you were to pay the balance and close the card. The opt-out option for fixed card card holders basically just allows you to avoid the rate increase on existing debt as long as you make no further purchases. In that situation the best bet would be to pay the balance, but not close the card unless there was an annual fee. In which case it might make sense to take the ding on your credit score and avoid the fee's.

We are thinking of buying a brand new home in a brand new neighborhood, what are the pros and cons?
My husband and I are newlyweds and we found this brand new housing development that was established 3 months ago, no one lives there yet, because the houses are still being built. This location is exactly where we want to be. The houses are affordable and beautiful. They come with standard features such as: Base lot, appliance package, vaulted ceilings in living room, full unfinished basement with the option to have it finished (extra $10k), 2 car garage, central/heating, front brick, bay window in kitchen, eating bar in kitchen, walk in closets, etc. There are alot of standards. We do have to purchase our own landscaping. This house's base price is $108,800 (located in NW of Wichita, KS). It's 1091 sq. feet starter home and its a 2bdrm 2bathroom split ranch, laundry on main floor.

When new homes are popping up all over an area that is just being developed, the values can sometimes take several years to increase due to constant supply and competition from new homes for resale homes. If the new homes are in an already established area, that is usually a good thing.
The main consideration would still be your plans, if you intend on staying in a home for a good long while then these other considerations really won't effect you as much, and you get the joy of purchasing your dream home as a newlywed and raising your family there being one of the first area homeowners which could be very exciting. 4 shakes a day sounds like you're trying to bulk up. If you want to lose weight, best thing to do is eat Breakfast: Egg whites and oatmeal. Lunch: Substitute lunch for a whey shake. Then Protein shake post workout. And chicken or fish, veggies and brown rice for dinner. Drink a gallon of water a day and you'll definitely start to lose weight. Just drinking 4 shakes a day won't help though.
