My mother just had her savings and checking bank accounts frozen by one of the credit card companies she owes money too. Even though my mother is with one of them debt consolidation agencies this happened over the weekend. I wanted to know what exactly happens now. Do they keep all her money? Can she fight it off? She just got paid Thursday and has no money, can they do this? If not then how do we do something about this. I thought if she was working her debt out with one of the agencies then this would not happen. I just need some information here. Thanks
NY is trying to pass a new law to ban CC lawsuits filed improperly by collection attorneys, also last year the Attorney General managed to have dismissed over 15,000 lawsuits and judgments obtained by unfair means now he want to trow out over 100,000 more, this is a big problem in New york.
I would consult with a consumer lawyer, she may be entitle to collect damages.
If that frozen account is the first notice she had about this attorney suing her the judgment is invalid and can be vacated for lack of service.
If she can't afford to consult with a lawyer write a complaint to the NY attorney general office and a letter to the court house explaining that she was never served with the summons in the first place, thats the reason why the collection attorney was able to obtain a default judgment.

how does a judgement on my credit affect a background check?
A judgement was placed against me because I had a delinquent credit card. II know it shows up on my credit report. 'm currently making payments on it. Will this show up on a background check that does not include a credit check?
If you are referring to an employer run background check then it is likely they will also run a credit check as part of the background check process. For that, they would need your express approval so you would know if they were running a credit check or not. Not every employer does this as it does cost them more money. And, just because you have this on your credit does not mean you will not be hired. I would suggest you be honest with them in the application.
